About Partner Visa

Types of Partner Visas
There are 3 types of partner visas that you can apply basis on your relationship. These are prospective marriage (subclass 300), provisional partner visa (subclass 820) and permanent partner visa (Subclass 801).
Prospective Marriage (subclass 300)
- Suppose you are overseas and plan to marry your prospective spouse, an Australian citizen, permanent resident, or an eligible New Zealand citizen in Australia. In that case, you can apply for this visa.
- You need to be offshore before applying for this visa, and you need to marry your prospective spouse before the visa period ends.
- If you decide to settle in Australia, you would be eligible to apply for the Partner visa (Subclass 820 and 801).
Partner Visa (if Overseas)
- You can apply for an offshore partner visa (subclass 309 & 100) if you are overseas and in a genuine relationship with your spouse or de facto partner, an Australian citizen or permanent resident, or an eligible New Zealand citizen.
- You need to first apply for the temporary partner visa or provisional partner visa (Subclass 309) before you apply for the permanent partner visa or partner (migrant) visa (Subclass 100).
- You should clear all the health and police checks.
- You or your partner should not owe any debt to the Australian government, or you need to have the arrangement to pay it back, and your partner should provide you with sponsorship.
Partner Visa (if in Australia)
- You are eligible to apply for a partner visa if you are in Australia if your spouse or de facto partner is an Australian citizen, permanent resident, or eligible New Zealand citizen.
- You need to first apply for the Temporary Partner Visa (Subclass 820).
- Those who hold subclass 820 provisional visas can apply for a permanent visa (Subclass 801).
- Once you have the permanent visa, you are entitled to live in Australia indefinitely, irrespective of the future continuation or discontinuation of your relationship with your partner.
- You also become eligible to apply for Australian citizenship in due course.
Check Your Eligibility for an Australian Partner Visa
- You must be the spouse, engaged to or in a de facto long-term relationship with an Australian citizen, permanent resident, or an eligible New Zealand citizen.
- Your partner should provide you with sponsorship.
- You and your partner must be 18 years of age or above.
- If you are not married, you and your partner must be in a serious relationship for more than 12 months.
- You should be able to provide satisfactory proof of relationship or cohabitation.
- You and your partner must be able to pass the interview along with authentic documentation.
Documents You Require for Partner Visa
